Unaware of the impending danger, she suddenly found herself plunging into a deep pothole, an experience she described as "just shaking." The impact of the collision cracked her windshield and triggered the check engine light, leaving her car in need of immediate attention.Adu-Gyamfi, a cautious driver who typically goes to great lengths to avoid potholes, was caught off guard by the sheer size and depth of this particular hazard. "I'm one person that I will dodge a pothole because my tires are very expensive to replace so I shy away from potholes, but I did not see it coming," she recounted.

Navigating the Bureaucratic Maze

In the aftermath of the incident, Adu-Gyamfi took the necessary steps to report the pothole to the authorities. On July 8th, she contacted Prince George's County, only to be directed to the Maryland Department of Transportation (MDOT) a week later.The MDOT, upon receiving an email from Adu-Gyamfi's husband, promptly addressed the issue, fixing the pothole on the following day. However, the question of who would be responsible for the damages to Adu-Gyamfi's vehicle remained unanswered.

Seeking Compensation: A Challenging Journey

According to the Maryland State Treasurer's Office, the state is not strictly liable for damages caused by potholes. Before a driver can potentially receive compensation, the MDOT's insurance division must investigate whether the State Highway Administration had prior knowledge of the roadway defect and whether they had sufficient time to make the necessary repairs before the incident occurred.Adu-Gyamfi has been assigned an adjuster from the state, who will conduct an investigation to determine if the state is at fault. "They're going to do their investigation and see if the state is going to be at fault or not," she said.The uncertainty surrounding the compensation process has left Adu-Gyamfi feeling frustrated and uncertain about the future of her vehicle. "I feel like I need my car fixed," she expressed. "I shouldn't have to come out of pocket to fix my car."
